Probate

Compassionate Guidance Through a Difficult Time

If you’re here because a loved one has passed, we are truly sorry for your loss. At Wellborn Law Firm, we aim to make the probate process as simple, clear, and stress-free as possible—so you can focus on what matters most.

What Is Probate?
Probate is a court-supervised process that ensures a person’s assets are properly distributed after their passing. If your loved one left a will, the court will validate it and oversee the administration of the estate. If there is no will, probate will determine how the estate is distributed under Georgia law.

The probate process includes:

  • Appointing an executor or administrator

  • Notifying heirs and creditors

  • Inventorying assets

  • Paying debts, taxes, and final expenses

  • Distributing the remaining assets to beneficiaries

Why People Worry About Probate
Probate has a reputation for being public, time-consuming, and expensive. Without the right guidance, it can be overwhelming. But with support from a trusted attorney, you can navigate the process with clarity and confidence.

Do You Always Have to Go Through Probate?
Not always. If your loved one had a properly funded trust or assets with named beneficiaries, those may pass outside of probate. However, if assets were held solely in their name, probate is likely required.

How Long Does Probate Take?
In Georgia, probate typically takes at least six months—and longer for more complex estates. Timelines depend on factors like creditor claims, disputes, and asset complexity.

How Much Does Probate Cost?
Costs vary depending on the size and complexity of the estate. Legal fees are based on Georgia law, and there are also court costs, filing fees, and possible appraisal expenses.

Can an Executor Be Held Personally Liable?
Yes. Executors are legally responsible for managing the estate properly. Missing deadlines or mishandling funds can result in personal liability. That’s why it’s so important to have experienced legal guidance.

What If My Loved One Had a Trust?
If a trust was properly created and funded, probate may not be necessary. But many people create trusts and don’t keep them up to date—leading to surprises after death. If you’re unsure, we can review your loved one’s plan and let you know what’s needed.
